THE 2012 LAWYERS ON THE FAST TRACK DaviD J. BirD Associate, Reed Smith Practice Profile: David has specialized in appellate litigation since joining Reed Smith in 2003. He routinely briefs and argues appeals in federal and state courts and handles dispositive motions at the trial level. His experience in the U.S. Supreme Court includes the preparation of certiorari petitions, oppositions to certiorari petitions, and amicus briefs filed at the petition stage and on the merits. “He has a natural ability to think on his feet that serves him well, even in front of the most difficult appellate judge or justice,” said Reed Smith part-ner James C. Smith. David appeared twice before the U.S. Supreme Court in the past year. The first time was in a pro bono case when he successfully argued against the Federal Aviation Agency. The second was in a case addressing whether federal regula-tions regarding railroad equipment maintenance supersede state regulations. Leadership Activity: David is a con-tributing author to the Third Circuit Bar Association’s newsletter since 2009. Pro Bono and Civic Work: David invested 395 hours of pro bono time in 2011. He helped represent plaintiff Stanmore Cooper in Cooper v. FAA , in which the HIV-positive pilot filed a Privacy Act suit against the government. Experience: Current employer: 2003-present.
